Voter registration deadline for the Special Town Meeting being held on August 26, 2020 is Saturday, August 15, 2020. Voter registration hours for the Special Town Meeting will be held on Saturday, August 15, 2020 from 2:00 p.m. to 4:00 p.m. and from 6:00 p.m. to 8:00 p.m. at the Clarksburg Town Hall, 111 River Road, Clarksburg MA

This is not a virtual meeting however it will be held outside, please adhere to social distancing guidelines and bring a chair/umbrella if necessary.

To any of the Police Officers of the Town of Clarksburg in the County of Berkshire:

Greetings:

     In the name of the Commonwealth of Massachusetts you are hereby directed to notify and warn the inhabitants of said Town qualified to vote in Town Meeting to meet at the Clarksburg Senior Center at 712 West Cross Road in said Town on Wednesday, August 26, 2020 at 6:00 p.m. then and there to vote on the following articles to wit:      

FISCAL YEAR 2021 ARTICLES to be voted on:                        

                                                                                   

ARTICLE ONE:  (majority vote)

To see if the Town will vote to authorize the Selectboard, pursuant to the provisions of M.G.L. Chapter 59, § 38H(b), and Chapter 164, § 1, and any other enabling authority, to negotiate and enter into a binding agreement for payments-in-lieu-of-taxes (PILOT), for personal property attributable to a solar photovoltaic facility to be installed and operated in the Town at 650 West Cross Road, Map 210, Lot 36, with such agreement to be on such terms and conditions, and for a term of up to 20 years as the Selectboard shall deem appropriate, and to authorize the Selectboard to take any actions and execute any other documents and ancillary agreements necessary, convenient, or appropriate to accomplish the foregoing and to implement and administer such an agreement, or take any action related thereto.

 

ARTICLE TWO:  (majority vote)

To see if the Town will vote to authorize the Selectboard, pursuant to the provisions of M.G.L. Chapter 59, § 38H(b), and Chapter 164, § 1, and any other enabling authority, to negotiate and enter into a binding agreement for payments-in-lieu-of-taxes (PILOT), for personal property attributable to a solar photovoltaic facility to be installed and operated in the Town at 641 River Road, Map 207, Lot 52 with such agreement to be on such terms and conditions, and for a term of up to 20 years as the Selectboard shall deem appropriate, and to authorize the Selectboard to take any actions and execute any other documents and ancillary agreements necessary, convenient, or appropriate to accomplish the foregoing and to implement and administer such an agreement, or take any action related thereto.

 

ARTICLE THREE: (majority vote)

To see if the Town will vote, pursuant to the provisions of M.G.L. Chapter 41, § 108A, and any other enabling authority, to amend the pay scale maintained as Attachment A to the Town’s Personnel Policy, by adding the following language in bold to the section “Pay Grade and Step”: Provided, however, that the Selectboard shall have the authority to place new employees at the appropriate Step of the Pay Scale based on prior experience and education at the time of hire.”, or take any action related thereto.

 

ARTICLE FOUR: (majority vote)

To see if the Town will vote, pursuant to the provisions of M.G.L. Chapter 41, § 1B, to render the position of Town Clerk an appointed office as opposed to an elected office, which statute allows the Select Board to provide for the appointment of such office for a term not to exceed three years, unless otherwise provided by law; provided, however, that any such vote be subject to approval at the Annual Town Election in accordance with the provisions of M.G.L. Chapter 41, § 1B, or take any action related thereto.

 

ARTICLE FIVE: (majority vote)

To transact any other business that may legally come before said meeting.

To any of the Police Officers for the Town of Clarksburg, you are hereby directed to serve this Warrant by posting two or more attested copies of the same, in the Town of Clarksburg at least FOURTEEN (14) days before the time of holding said meeting.
